CLASS CARD LLP (hereinafter “Voomo”, “We”, ”Our” or “Us” which expression, unless repugnant to the context hereof, shall mean and include its successors, subsidiaries and assigns) is the owner and developer of Voomo’s products and services, including but not limited to, website (https://voomo.ai and https://app.voomo.ai) (“Website”), applications, software, application programming interfaces, tools, data and documentation offered on the Website and our mobile apps (collectively, “Services”). The Services are used by Voomo’s registered users (“User”) to generate and export content including but not limited to, images, audio, video, recordings, data and text. The Service also allows Users to export generated content or share it with their viewers (“Viewers”).
We at Voomo are committed to safeguarding the privacy of our customers. This privacy policy (“Privacy Policy”) describes how We collect, use and disclose personal information about individuals who access and use our Website (“Visitors”) and our Users and Viewers who access, use and interact with our Services. Each of the Users, Viewers and Visitors shall also be referred to herein as “you” or “your”. We refer interchangeably to “personal information” and “Personal Data”, which, depending on the jurisdiction, means the data or information based on which a person can be identified. For purposes of this Privacy Policy, We are the controller only if we process personal data for our own legitimate purposes, as described in the section titled “Why do we process your data and what is our legal basis?”

What type of Personal Data do we process?
- Information You Provide Us: Some features of the Services may require you to provide us with information directly. You may elect not to provide this information, but doing so may prevent you from using or accessing these features. Depending upon your use of our Services, we may collect some or all of the following information about you:
- Account and contact information: When you register an account with Us, we collect your name, email address and account password. We may also collect other information associated with your account, such as your phone number, business/organization name and position, mailing address and social media handles. Depending on the plan that you subscribe to, we may collect payment information and transaction history. Voomo uses Paddle (https://paddle.com) as a third party payment processor and all payment information is stored with them. You may find their privacy notice link here. This data is necessary to provide you with the Services.
- Customer Provided Content: When you use our Services, we collect personal information that is included in the text, voice, scripts, images, videos, and other Customer Provided Content (as defined in our Terms) that you choose to provide (basis your decision) to generate audio, videos, avatars, and other forms of output, alongside metadata associated with the Customer Provided Content. Some of the features of the Services require us to process parts of voice, faces or bodies within a video, photo or audio recording. We may use the Customer Provided Content that you provide us to improve our services, for example, to train and enhance the models that power our Services.
- Information posted to the Services: Certain features on the Services may enable you to share templates or make your videos and other content available to other users. We collect information that you choose to share or make available (“UGC”), and we, or others, may store, display, reproduce, publish or otherwise use UGC (including with your name and email address) and may or may not attribute it to you. Others, including other users, may also have access to UGC and may have the ability to share it with third parties.
- You may decide to share further information, including personal data, with us when you contact us, provide feedback to us regarding the Services or otherwise communicate with us. It is solely your decision to share any other data with us during such communications, so our processing of such data will be based on your consent.
- If we engage you to provide services to us we may collect your name, contact details and invoicing details. Further if we are engaging you to create stock avatars, you will need to provide us with images and/recordings of your likeness and/or voice.
- We will not collect any sensitive personal data (as defined under applicable law) without your prior consent
- Information Collected Automatically: We automatically collect certain information about your interaction with the Services (“Usage Data”), including through cookies, web beacons and other technologies (“Tracking Technologies”). This information includes:
- Device information, such as device type, operating system, unique device or browser identifier, and IP address.
- Location information, such as approximate location based on IP address
- Other information regarding your interaction with the Services, such as your operating system, browser type, date and time stamps, clickstream data (including referring site, the types of content that you view or engage with, the features that you use, and other actions you take on the Services, as well as the site you exit to), interaction with our emails, and interaction with ads that you see as a result of our personalisation and insight and analysis activities.
- Diagnostic data including crash logs, launch time, hang rate and energy use, and any other data collected for technical diagnostics purposes

- Information From Third Parties: We may obtain information about you from third parties from time to time, including:
- Partners: We receive information about you and your activities on our website from third-party partners, such as advertising partners and/or data enrichment partners. Third party partners may collect information directly through cookies and other tracking technologies on our sites and/or third party digital properties.
- Service Integrations: Information we receive when you connect Voomo to an integration service.
- Login integrations: Information we receive when you choose to access the Services through a login integration or a Single Sign On service.
- Social media platforms: Information we
receive from social media platforms, such as when you interact with us on YouTube, TikTok or
Instagram.

Why do we process your data and what is our legal basis?
Subject to applicable law, We may process your personal data for several purposes. How we use your personal data depends on how you use our Service and your preferences you have communicated to us.
- Providing and managing your Account and access to and use of our Services. It is necessary to perform our obligations under the Terms of Service agreement between you and us. Where we do this on behalf of our client (including your organisation) as a data processor, we do not require a legal basis for such processing
- Personalizing and tailoring your experience with our Services, including surfacing recommendations, enabling you to create Customer Generated Content and generating such output for you. It is necessary to perform our obligations under the Terms of Service agreement between you and us.
- Providing customer support, responding to communications from you, sending you necessary information via email or announcements relating to your account. It is necessary to perform our obligations under the Terms of Service agreement between you and us. Please be aware that you cannot opt out of receiving such messages from us, including necessary security alerts and legal notices. You will only be able to opt out of receiving such messages by terminating and deleting your account with us. If you wish to delete your account, please contact us using the details in the “Contact Us” section of this Privacy Policy. It is important that you are also aware that we may still need to retain some of your Personal Data as required under applicable law or for the legitimate purpose of our business, even after you have chosen to delete your account.
- Sending you marketing communications (with your permission/consent or where otherwise permitted by applicable law). Unless permitted by law, we will not send you unsolicited marketing communications. You can unsubscribe from our emails at any time by contacting us using the details in the “Contact Us” section of this Privacy Policy or by using the unsubscribe/opt-out function displayed in our communications to you. We may also use the content you upload to the services with certain third-party software tools to tailor and enhance our marketing and sales outreach to you.
- To train and enhance the models that power our products and services, including to make our models more accurate. It is necessary for our legitimate interest and subject to appropriate safeguards. You may request to opt-out of this training and enhancement by contacting us using the details in the “Contact Us” section of this Notice
- We may process technical data and usage data to provide you with, and analyse the effectiveness of, personalised ads when you use our Services. By “personalised ads”, we mean advertisements for products and services that you have shown an interest in when you have used our Services or which we or our partners otherwise think you might be interested in based on your browsing habits. Note, our third-party partners may also use the data that is collected to show personalised ads for products and services offered by third parties. We do this where we have legitimate interests to provide effective insights and analysis or with your consent where non-essential cookies are used.
- Understanding the usage of our services, understanding trends and preferences, improving and repairing errors in the services, and in this context developing new products, services, features, and functionalities. Third parties we share your data with

We may contract with third parties who help us provide the Services, including but not limited to, for payment processing, cloud storage, chatbot operation, customer support, voice transcriptions, voice generation, video generation, image generation, script generation, system administration, security, customer relationship management, delivery of goods, search engine facilities, data analytics, advertising, and marketing. In some cases, these third parties may require access to some or all of your personal information and may help us provide the Services by storing or processing your data on our behalf.
- Legal Obligations: We may disclose or share your personal data in order to comply with any applicable law, legal obligation, legal process or governmental request. We may also disclose information to enforce our contractual arrangements and policies (including investigations of potential violations and frauds), or protect or defend the Services, our rights and interests, and the rights and safety (including intellectual property rights and other legal rights) of yourself or any other third party.

- Affiliated Companies and Corporate Transaction– we may share your Personal Data with a parent company, subsidiaries, joint ventures, or other companies under common control with the Company ("Affiliated Companies") solely if and when applicable or necessary. Although we may provide links to third-party websites or platforms, or display content, data, applications or materials from third parties, our Privacy Policy does not apply to those third-party sites or materials, and your browsing and interaction on any third-party site, application, or service, including those that have a link on our Services, are subject to that third party's own terms and policies. Retention of Your Personal Data
We retain Your Personal Data for as long as it is needed for the purposes set out in
this Privacy Policy, unless a longer retention period is required or permitted by law. We will retain and
use Your Data to the extent necessary to comply with our legal and regulatory obligations, resolve disputes,
and enforce our legal agreements and policies. When we have no ongoing legitimate need to process your
personal data, we will either delete or anonymize it in accordance with our deletion policy. We may rectify,
replenish or remove incomplete or inaccurate information, at any time and at our own discretion.

Cookies and Other Tracking Technologies
The Site and Services may use certain Tracking Technologies to collect Usage Data, including first-party Tracking Technologies (those placed directly by us and are used only by us) and third-party Tracking Technologies (those placed by websites, services and/or parties other than us). These Tracking Technologies include those provided by Google Analytics, MixPanel, DoubleClick and Meta.
We use Tracking Technologies because it is in our legitimate interests to facilitate, improve and tailor your experience with the Services, run analytics, de-bug and to provide and improve our products and services. For example, we use MixPanel to better understand our user’s experience and this enables us to build and maintain the Services with user feedback. We also use Tracking Technologies for advertising related purposes, including for remarketing and to deliver targeted ads to you, and analyze and measure the effectiveness of our advertisements
